Malicious node operators could exploit this to front-run stakers' funds, causing them to be credited to the attacker's builder account, while the corresponding validator cannot be activated. The related fix proposal consensus-specs 5735 has been closed with "not planned" status, and defense requires each staking protocol to conduct its own pre-deposit checks.
